What the service is

whatsapp.cubicsofts.ae is a messaging gateway. You link a WhatsApp number you control, and we let your software send and receive messages on it through an HTTP API.

This is not the official WhatsApp Business Platform, and we are not affiliated with, endorsed by, or connected to WhatsApp LLC or Meta Platforms. The gateway drives an ordinary WhatsApp session, which is what allows you to keep your existing number.

The risk you are accepting

Automating a WhatsApp number in this way is contrary to WhatsApp's own terms of service. WhatsApp may restrict, suspend or permanently ban a number it considers to be sending spam or behaving automatically.

That risk falls on the number you connect, which is yours. We provide daily caps, send pacing and guidance to reduce it, but we cannot eliminate it and we do not indemnify you against it.

If a banned number would seriously harm your business, tell us and we will help you onto the official WhatsApp Cloud API instead.

Acceptable use

Message only people who expect to hear from you, and only about things they would reasonably expect: order updates, reminders, one-time passcodes, service notices, and replies to their own messages.

Do not send unsolicited marketing, purchased lists, chain messages, or anything unlawful, deceptive, harassing or infringing.

Honour opt-out requests immediately. Continuing to message someone who asked you to stop is grounds for suspension, aside from being unlawful in most markets.

Do not resell access, share API keys outside your organisation, or attempt to evade sending limits.

Your account

You are responsible for keeping your password and API keys secret, and for everything sent using them.

Tell us immediately if you believe a key has leaked so we can revoke it.

Payment

Plans are billed in advance for the period shown at checkout. Message credits are consumed as you send.

We may change pricing with 30 days notice. Changes never apply to a period you have already paid for.

Unpaid accounts are suspended, and suspended accounts stop sending. Data is retained for 90 days before deletion.

Availability

We aim for high availability and monitor the platform continuously, but we do not guarantee uninterrupted service.

Parts of the service depend on WhatsApp, which we do not control. An outage or protocol change on their side can interrupt delivery through no fault of ours.

Liability

To the extent permitted by law, our total liability is limited to the fees you paid in the three months before the claim.

We are not liable for indirect or consequential loss, including lost profit, lost business, or the consequences of a WhatsApp number being restricted or banned.

Termination

You may close your account at any time from the dashboard.

We may suspend or terminate an account that breaches these terms, that generates spam complaints, or that puts the platform or other customers at risk.

Governing law

These terms are governed by the laws of the United Arab Emirates, and disputes are subject to the exclusive jurisdiction of its courts.
